Terms of Service

The Oceansky website(s), our APIs, our mobile application (the "App"), and any other software, tools, features, or functionalities provided on or in connection with our services (collectively, the "Service") are subject to these terms of service ("Terms").

This includes, without limitation, using our services to view, explore, and create NFTs and using our tools to connect directly with others to buy, sell, or transfer NFTs on public blockchains. In these Terms, "NFT" refers to a non-fungible token or comparable digital object deployed on a blockchain (such as the Ethereum blockchain), which makes use of smart contracts to link to or otherwise be connected to certain content.

In these Terms, 'user,' 'you,' and 'your' refer to you as a user of the Service. You represent and warrant that you have the authority to bind the entity you represent, whether it be an individual or a corporation, to these Terms. If you use the Service on behalf of an entity, you agree to these Terms on its behalf.

The terms of service include a mandatory arbitration agreement and a class action waiver that, with some exceptions, require any disputes between us to be resolved through individual arbitration rather than in a court of law in front of a judge or jury.

These provisions are described in Section 16 below.

By using our service or clicking to accept these terms, you agree to be bound by all of the terms and conditions contained in this agreement and any terms incorporated by reference. If you do not agree to these terms, you are not permitted to access or use the service.

Oceansky is a peer-to-peer web3 service that allows users to find and communicate with NFTs (non-fungible tokens) that are accessible on public blockchains. However, we do not act as a creditor, exchange, broker, financial institution, or wallet provider. We do not execute or facilitate the purchase, transfer, or sale of NFTs, and we do not have control over or custody of the NFTs or the blockchains you interact with. To use our service, you will need to have a third-party wallet that allows for blockchain transactions.

Peer-to-peer (P2P) web3 refers to a decentralized network architecture in which users can directly connect and interact with each other, rather than relying on a central server or authority. Web3 refers to the third generation of the World Wide Web, which is focused on the use of decentralized technologies such as blockchain and distributed ledger technology. In the context of P2P web3, users can interact with each other and with decentralized applications (dApps) directly through the use of blockchain technology. This allows for greater security, transparency, and decentralization, as well as the ability to create and use decentralized applications that operate on a global, open-source platform.

Please note that Oceansky is not a party to any agreements between users. We cannot verify the identity, legitimacy, or authenticity of users or NFTs (including any content associated with such NFTs) that are displayed on the Service. It is your responsibility to confirm the identity, legitimacy, and authenticity of any NFTs that you purchase from third-party sellers through the Service.

We occasionally need to provide extra conditions for certain services due to our expanding list of offerings (and such services are regarded to be part of the "Service" hereunder and shall likewise be subject to these Terms). If you use one of these services, the additional terms and conditions that apply to that service will become part of your contract with us. In the event of a conflict between these terms and the additional terms for a specific service, the additional terms for that service will take precedence.

These terms are subject to change at any time at the discretion of Oceansky. If we make significant changes to these terms, we will try to notify you, for example by posting a notice on the service or updating the "Last Updated" date at the top of these terms.

By continuing to use the service after these terms have been modified, you agree to be bound by the new terms and all terms that have been incorporated into them by reference. It is your responsibility to regularly review the terms to check for any changes and to ensure that you are familiar with them before using our services.
